Our Family Constitution program has 4 modules, each of which is a value creator in its own right. We tailor the program to the situation and needs of your business. During the process, we help family members to be as honest as possible with themselves and with each other about their personal, business, ownership and family histories, roles, relationships, skills, values, career profiles, needs and aspirations. From this series of conversations, a set of definitions for the constitution will emerge, while creating consistency, informational symmetry and clarity within the family.

With family members who understand the family situation well, it is possible to effectively outline and specify future options, to choose procedures and to conclude agreements that are in line with the family's co-operation and differences.

The process of establishing the family constitution:

Situation review

This is the first and therefore the most interesting, perhaps the most difficult, also probably the most important step towards having a family constitution. The values and the situation overview together explored, studied and discussed by the family members will be the basis for all further considerations. Family members should be as honest as possible, both to themselves and to each other, about their common and personal, business, ownership and family history, their roles, relationships, skills, values, needs and desires. These conversations both produce a set of definitions for the constitution and create consistency and clarity.

Visions

We help to clarify and compare the individual and joint visions of family members – concerning personal life, professional career and financial expectations – with the strategic possibilities of the business(es) and wealth. We help the essential parts of these visions in coalescing into one, with compromises acceptable to everyone. We will also examine how the family's future vision will interact with the company and asset management in a few years' and generations' time. Those families that know their family members' vision for the future are already on the finish line.

Agreements

In practice, this module is where the family constitution is created. Basic definitions; the drawing of clear and enforceable boundaries between family, business and property; rules for everyday and extraordinary situations; formalised decision-making forums and informal solutions for their future operation; conflict management mechanisms. It can be either high level, clarifying only questions of value, or very detailed, covering specific issues. Domestic and international best practices can be used, it is our task to present and model them, but at the end each family will only be able to maintain the constitution it has created for itself! At this point in the process we usually involve legal and estate planning experts.

Implementation

The family constitution is not a legal document. It is a set of agreements and definitions made between family members, based on a vision of the family and its situation. In the implementation phase we help to implement the elements of the family constitution in legal and property structures. Based on our experience ranging from the simplest wills to complex wealth structures, we help to plan and support the steps of implementation and then to channel its operation into family decision-making forums and institutions.

Following the program, reforming the legal and financial structure will take 1-2 years, based on the agreements made in the Family Constitution and the implementation plan.

Together with his brothers, he is the second generation owner-manager of Oasis Horticulture.With a wealth of practical experience in successful generational change and managing family-business conflicts.

The Boross family was among the first to recognize the need for a family constitution and then followed through with the process. David has been an active board member for ten years and since 2019 he has been the President of the Responsible Family Businesses Network in Hungary (FBN-H). In contrast to the domestic 1-2 generation businesses, the international FBN organisation has thousands of 3+ generation family businesses as members, from around 30 countries, from European, North and Latin American and Asian cultural backgrounds.
